Elder Abuse

The number of persons 65 and older who are abused, neglected, and exploited by family members and others has reached epidemic proportions.
Elder abuse includes:

  • Intentional or negligent physical abuse, pain, or injury
  • Sexual abuse
  • Emotional or psychological injuries caused by threats, intimidation, humiliation, or neglect
  • Financial exploitation and fraud
  • Caretaker neglect to provide even basic care and needs

Elder abuse also includes injuries due to nursing home and residential care negligence.

The type of damages that may be recovered in an elder abuse case include the cost of medical care, lost wages, reimbursement of stolen money, compensation for physical or mental injury, attorneys fees, and punitive damages to punish truly egregious wrongdoers.

People who are younger than 65 are also protected by the law if they have temporary or permanent incapacities that prevent them from being able to protect themselves or make health care decisions for themselves, or if they are easily susceptible to coercion, duress, or fraud. These people have the same legal remedy as an elderly person.
